Oct 1–Dec 31 2026 FDA food facility biennial renewal window is open — confirm or switch your U.S. Agent

The FDA food facility biennial registration renewal window opens October 1, 2026 and closes December 31, 2026. FDA's renewal user guide states the period exactly: October 1, 2026, 12:01 AM through December 31, 2026, 11:59 PM. Every facility that manufactures, processes, packs, or holds food for consumption in the United States and is required to register must renew inside that window. A registration that is not renewed by the deadline is considered expired, and FDA's renewal guide says an expired registration is removed from the account.

For a foreign facility that means one thing in practice: if the registration lapses on January 1, there is no valid FDA registration behind its shipments until it registers again.

This post is deliberately short: what renewal is, the checklist to run before December 31, and why the window is the right moment to confirm or replace a U.S. Agent. For every date, rule, and trap in detail, the comprehensive guide is here: FDA Food Facility Registration Renewal 2026: every date, rule, and trap.

What biennial renewal is

Biennial registration renewal is the even-year, October 1–December 31 process under Section 415 of the Federal Food, Drug, and Cosmetic Act and 21 CFR 1.230(b), in which every food facility required to register with FDA re-confirms its registration; it is a separate function from a mid-cycle registration update.

Two points matter. First, there is no FDA government fee for registration or renewal ($0) — FDA's guidance says there is no fee for registration, registration renewal, or updates to a registration. Anything you pay goes to a service provider or a U.S. Agent, not to FDA. Second, updating is not renewing. FDA's renewal user guide is explicit that updating a registration is a different function from renewing it, and during the renewal period the update function is not available until the registration has been renewed. Changes to registration information must still be reported within 60 calendar days under 21 CFR 1.234; renewal is the separate, even-year confirmation that the registration itself stays alive.

Renewal and U.S. Agent checklist for foreign facilities

Before December 31, a foreign facility should confirm that its registration is current, that its required identifiers are in order, and that the named U.S. Agent is still valid and reachable — and update the Agent during renewal if it is switching.

Run this list early in the window, not in the last week of December:

  • Confirm you are in the correct FDA account and the correct registration record for the facility. Group registrations and legacy accounts are where facilities lose time.

  • Review the facility's registration data as part of renewal — name, address, activity types, emergency contact. Under 21 CFR 1.232, a foreign facility's registration must also carry the U.S. Agent's name, address, phone, and email.

  • Unique facility identifier: FDA's renewal guide states that all facilities must include a UFI acceptable to FDA, and FDA recognizes the D-U-N-S number as an acceptable UFI. Check that the number on file still matches the legal entity and address.

  • U.S. Agent still valid and reachable: a named person, a working phone, a monitored email. Under 21 CFR 1.231, FDA will not confirm a foreign facility's registration or renewal until the person identified as the U.S. Agent confirms they agreed to serve. An Agent who cannot be reached can stall the renewal itself.

  • If you are switching Agents, do it as part of the renewal, so the confirmed record going into 2027 carries the right contact. Axentra can handle the update on the facility's behalf.

Why renewal is the moment to switch your U.S. Agent

Renewal is a natural point to replace an unreachable, mailbox-style contact with a dedicated U.S. Agent who maintains a real U.S. place of business and can respond when FDA needs the facility's domestic contact.

The regulation sets the floor. 21 CFR 1.227 defines the U.S. Agent as a person residing or maintaining a place of business in the United States, and says the agent may not be a mailbox, answering machine or service, or other place where a person acting as the U.S. Agent is not physically present. Above the floor the questions are practical: does anyone answer the phone, does FDA correspondence reach a person who understands it, and does the facility have a named contact rather than a shared queue.

Foreign manufacturers switch for ordinary reasons: the current arrangement does not respond to FDA or to the facility's own questions; the listed address is a forwarding service; the facility has grown into a mid-market exporter and wants senior, dedicated support rather than a high-volume account. None of that needs a villain — it needs a better fit. If the mailbox-versus-active distinction is new to you, the earlier post covers it: Mailbox vs Active U.S. FDA Agent: what to require in 2026.

One line to keep straight: appointing a U.S. Agent, registering, or renewing does not mean FDA has approved the facility or its products, or verified the information submitted. Registration is a listing obligation, not an approval.

What Axentra does during the 2026 window

Axentra Global Pharma Compliance LLC acts as a dedicated U.S. Agent for foreign food facilities from a real place of business in Albuquerque, New Mexico, and supports the biennial renewal filing and any Agent change at renewal.

Axentra U.S. Agent services for food facilities are $249 per facility per year. There is no FDA government fee for food facility registration or biennial renewal ($0).

What that buys is a named, senior regulatory contact who confirms the appointment with FDA, receives and routes FDA communications, and is reachable when an inspection or import question lands. The facility keeps ownership of its FDA account.

Frequently asked questions

When is the FDA food facility biennial renewal window in 2026?

It opens October 1, 2026 and closes December 31, 2026 — the even-year cycle set by 21 CFR 1.230(b). FDA's renewal user guide states the period as October 1, 2026, 12:01 AM through December 31, 2026, 11:59 PM, and says a registration not renewed by the deadline is considered expired. The full guide to every date and trap is here.

Is there an FDA fee for food facility registration or biennial renewal?

No. FDA states there is no fee for registration, registration renewal, or updates to a registration ($0). Axentra U.S. Agent services for food facilities are $249 per facility per year. See U.S. Agent services and FDA food facility registration.

Can I change my U.S. Agent at biennial renewal?

Yes. Renewal is the operational moment to confirm the Agent is reachable and to update the named Agent if you are switching; under 21 CFR 1.231, FDA will not confirm a foreign facility's renewal until the named U.S. Agent confirms they agreed to serve, so the new Agent has to be in place and responsive. Axentra U.S. Agent for food facilities is $249 per facility per year. Axentra can help: U.S. Agent services.
