Domestic facilities still carry registration, listing and labeling obligations. - **U.S. Agent and FSVP Importer are different roles held by different parties.** The U.S. Agent represents the foreign facility and is required for that facility to register at all. The Foreign Supplier Verification Program obligation sits with the U.S. importer of record. One does not satisfy the other. - **There is no such thing as "FDA approved" or "AAFCO approved" pet food.** FDA approves food additives, not finished products. AAFCO is not a government agency and approves nothing — it publishes model regulations and ingredient definitions that individual states adopt and enforce. Pet food is regulated at two levels: FDA federally, and state feed control officials using AAFCO model rules. - **Bemotrizinol (BEMT) carries an exclusivity period.** FDA added bemotrizinol to OTC Monograph M020 on 9 June 2026, effective 9 August 2026, at concentrations up to 6 percent. Final Administrative Order OTC000039 grants DSM Nutritional Products LLC — and its licensees, assignees or successors — 18 months of exclusivity from the effective date under FD&C Act section 505G(b)(5)(C)(i), running into early 2028. Market entry during that period runs through a DSM licence or supply arrangement, not an independent filing. - **eCTD v4.0 is accepted for new applications only.** FDA has accepted eCTD v4.0 for new NDAs, BLAs, ANDAs, INDs and master files since 16 September 2024, but forward compatibility is not yet available, so an application already running in v3.2.2 cannot simply switch mid-lifecycle. Both versions remain supported; the current list is in the FDA Data Standards Catalog. - **Food facility registration renewal is biennial and time-boxed.** Registration must be renewed between 1 October and 31 December of every even-numbered year (21 CFR 1.230). 2026 is a renewal year. A registration that is not renewed during that window expires, and FDA cancels expired registrations; failure to register or renew is a prohibited act under 21 CFR 1.241. Shipments from a facility without an active registration can be refused at the U.S. port. - **Drug establishment registration runs on an annual cycle, not a biennial one.** Registrants must review and update their registration information each year between 1 October and 31 December (21 CFR 207.29) — a different cycle from food facilities. - **MoCRA adverse event reporting runs on a 15-business-day clock.** Serious adverse events must be reported to FDA within 15 business days of the responsible person receiving the report, using MedWatch Form 3500A, with new and material medical information reported within one year. Records of all adverse events — not only serious ones — must be retained for six years (three years for eligible small businesses). - **Cosmetic labels must carry a U.S. contact for adverse event reports.** A label without a U.S. address, phone number or electronic contact through which the responsible person can receive adverse event reports risks misbranding. - **Dietary supplement notification deadlines differ.** New Dietary Ingredient notifications must be filed at least 75 days before interstate commerce (21 CFR 190.6). Structure-function claims must be notified to FDA within 30 days of first marketing the claim (21 CFR 101.93). - **FDA charges no fee for food or cosmetic facility registration.** Any quoted fee is a professional service fee, not a government charge. ## MoCRA / cosmetics — key facts Axentra advises on - MoCRA requires every facility that manufactures or processes cosmetics for the U.S. market to register with FDA, and requires each marketed cosmetic product to be listed. - Cosmetic facility registration renews every two years. - Foreign cosmetic facilities must designate a U.S. Agent. - Responsible Persons must maintain adverse event records and report serious adverse events to FDA within 15 business days. - Safety substantiation records must be maintained for every marketed product. - Labeling and claims must comply, including the required U.S. contact for adverse event reports; fragrance allergen labeling rulemaking is in progress under MoCRA. ## Key guides and resources - [FDA Food Facility Registration — Domestic & Foreign Renewal Guide 2026](https://www.axentracompliance.com/post/fda-food-facility-registration-domestic-foreign-renewal-guide-2026) - [What Happens If Your FDA Food Facility Registration Expires?
